In recognition of Breast Cancer Awareness Month, BRMM Law attorney Danielle Mayoras joined WWJ Newsradio 950's Tony Ortiz to discuss the legal protections available to people diagnosed with breast cancer, and the estate planning steps that can protect them and their families.

Your rights at work

Asked what legal protections are in place on the job for someone diagnosed with breast cancer, Danielle pointed to the Americans with Disabilities Act (ADA). Under the ADA, employers must make reasonable accommodations for people with disabilities, which can include someone with a cancer diagnosis. Those accommodations may include flexible work hours, time off for medical appointments, more breaks, or modifications to the job.

The interview also noted a recent survey finding that 77% of women diagnosed with breast cancer believe continuing to work is aiding in their recovery, a view shared by 92% of the healthcare professionals who responded.

Get your estate plan in place

In the second segment, Danielle explained that the biggest step is to make sure your estate planning, both legal and financial, is in place. Ideally that happens before a diagnosis, and it means having financial and medical powers of attorney as well as wills and trusts.

  • If you already have documents in place, this is a good time to review them and make sure they reflect your wishes and are up to date.
  • If you do not, it is critical to meet with an estate planning attorney and get them in place.

Danielle called a medical power of attorney an absolutely critical document, because the person you name can have the final say on any necessary medical treatment if you cannot make those decisions for yourself.
